Peter: I don't mean to flog a dead horse but....I want to make sure I am clear on the membership. You do not know yet if/what "gifts" we will receive for the different levels of memebership? Is that correct? Is your thinking we will automatically receive a t-shirt for a mere $35 membership or is that extra? The way I understand it the brochure is a work-in-progress and is not finalized...is that correct? |

The brochure is correct in the benefits for each level. The t-shirts/hats are for the $100 level, notecards for the $50 level, etc. What I'm not clear on yet is how we will "sell" additional t-shirts, hats, and notecards. I'm trying to avoid sales tax issues, etc. and I think that "gifts" can only be worth a portion of the "contribution". Anybody out there have experience with other non-profits. Do you pay sales tax when you get the notecards from the bird rescue organization that was mentioned a few days ago? I want to make the t-shirts, hats, and notecards available to non-members because it is a good way to get our name out there and generate even more interest. |

Peter: I will have to go back and read the brochure again, then. The first time thru, I did not see where it specified what you received for each level...I'll check it out later. Regarding non-profit "gifts" and sales tax, etc....I think the wording you want to use is....for a DONATION of $35, you can receive an additional t-shirt. That way you are not selling them. (You will often see this term used when organizations "sell" raffle tickets, spaghetti dinners, etc as fundraisers) Technically, the donor cannot include the value of the t-shirt, etc in the tax deductible portion of their donation. Sales tax, I'm not sure about. State Board of Equalization (sales tax police) wants to tax everything they possibly can. At some point, there is an end user (consumer) who is to be taxed. One way to possibly get around this is for IWS to pay sales tax, as the end user, when they purchase the t-shirts, etc. rather than buying them wholesale. Then when they send them to a donor, include a statement saying something like, "$25 of your donation is tax-deductible" implying that $10 was the cost of the shirt. Is this now clear as mud???? I will do some research for you through my SBBA (Santa Barbara Bookkeepers Association) posting to see if anyone there has some advice regarding the sales tax issue with non-profits and I'll also contact the Board of Equalization anonymously so they don't come looking for you. While I'm at it, are there any IRS tax ramifications about this that you are concerned with? SBBA is a great supportive group with a collective wealth of knowledge. Darrell: do you have any experience regarding the sales tax issue thru FOE? Most of my non-profit experience is church related and churches are an entirely different structure. Ok...I'm off for the day...will check back later when I can. |

We "sell" popcorn each year for our boy scout council/troop. You "donate" $15 and you "get" a popcorn item. I know we don't charge sales tax when we collect the monies as the boys sell. I don't believe the council has to pay either (they coordinate the "sale" and delivery. I agree - I think it's in the wording/offer as a not-for-profit entity. We also "sell" candy bars - same thing of no tax. Does IWS have an accountant or attorney on retainer - they should be able to easily answer that question. |

Popcorn is food and is not taxable. California Sales Tax laws would be different from New York. However.........if IWS sells/ships to another state, it is not taxable. It is considered Intrastate (Interstate) sales on the form and therefore is not subject to Calif. Sales and Use tax. YES!!! If you have an accountant, that is your best source for information! They are probably the ones that would have to prepare the forms, etc. And there may be a difference between selling door to door like Little League, Band, Scouts, etc and putting something on the internet or mailings. When you buy scout stuff (badges, uniforms, etc) at the scout headquarters....you pay sales tax. At least I think we did???? Your best bet is checking with an accountant. |

Tourists get taxed for sleeping in Santa Barbara. There is a bed tax when you stay in a hotel/motel. I think it is a city tax and not a county tax. <_< |

Yes and if you've done any traveling anywhere, the airport - car & hotel taxes have all gone up and are a bigger chunk of the fees!! And if I didn't pay - I'd never get to have any fun experiences and see wonderful sites - sooooo.... they got me don't they! |
