Recently, YouTube saw fit to take down episodes 1 and 2 of LittleKuriboh's Yu-Gi-Oh! The Abridged Series for copyright infringement. HOWEVER, what LittleKuriboh has done was create a parody of the series. And parodies are in fact protected by law. Needless to say, the deletion of two YGO: TAS episodes has started a major uproar on YouTube. There's no room for sarcasm when a serious topic is being discussed. YouTube is claiming to take down these videos due to copyright infringement when they're actually parodies, which are protected by law. Think about Robot Chicken for an example. If what YouTube has done is the case, wouldn't Seth Green be getting sued by thousands? |

*Plays the counter-side* Regardless of whether parodies are protected by law or not, you all seem to miss one thing. Youtube, and all content provided by Youtube, including the bandwidth to host videos, are all owned by Youtube, and it's parent company, Google. Thus, they have the legal right to do whatever they damn well want on their site. If they want to ban everyone whose name starts with A, B, or C, they can. If they want to remove a video rather then deal with the company, even if the video is protected by law, they will. Otherwise, they'd have to take it to court to prove it's a parody, and YouTube has no need to do it at all. Ever read a ToS completely? |

First of all, Bullcrap, AMZ. We all know you're biased on this subject. We ALL don't like it, but YOU are the only one who makes it such a big deal, enough so to warrant disccussion. Secondly, think logically. Google now owns YouTube. What would happen to your companys stock, and public opinion if say, you we're SUED for copyright infringement, not just taking down videos? Jah. ALL OF YOUTUBE goes under if they're sued. Google trys to cut off ties with YouTube to preserve self-image, and poof, bye-bye YouTube, which is now a headless chicken. You forget, more then half the videos on YouTube are in English, and with America and England the primary world power countries where English is the first language(Sorry Canadian members, We americans aren't ever educated about your state of economy, so I might be wrong here), and that means a lotta copyrighted material is in American hands. Know what happens with copyright infringement in America? LAWSUITS! It's the culture, something happens to you, the first thing you do is find the person with the deepest pockets connected to your accident, and sue 'em. I don't like it, but I'm but 15 years of age, so don't coem to me asking to do anythign about it! Anyways, with the U.S.A's love of lawsuits established, back to the point. Google is now responsible, and they have DEEP pockets these days. Lawyers are practically going on a TREASURE HUNT to find a reason to sue them. Punitive damages brought on by a child accessing smut through their servers? Oh yeah, they'd do it. So Google, quite understandably does NOT want to get sued. The only solution I see, would be if Google signed agreements with Copyright holders, so that videos could be posted freely. Sadly, rights to a series are almost as expensive as a lawsuit itslef, so don;t expect that anytime soon... |

But you also have to consider that the videoes put up were ued in a satirical nature, and thusly is not a copyright but rather a parody. Copyright laws do not extend to satirical parodies, yet youtbue still takes down such videos. They also take down videoes that include disclaimers even though the makers of the videoes denounce all rights to the property of which they gain material. If it continues then google could still be under threat of lawsuit. And Youtube would still flourish without google, considering it was an indie project. |

No. Youtube would sink without Google. Youtube was heading to a financial sinkhole until Google bought them out. And frankly? If I was Youtube/Google, I would dump it, parody or not, even if it's not technically copyright through parody. They try to sue, Youtube has to go to court and prove it's NOT COPYRIGHT, something that is much harder then to prove it is, specially in this day and age of stupidity. And frankly, it's not worth the loss of revenue to them. No skin off their back, the use of YouTube is not a right, it's a privilege, one that they are legally allowed to revoke at any time. All these complaints do is irritate the head honchos. @ Exponent: Actually, I'm right, and PM agrees with me. xD I was first. And Google isn't screwed. They can do whatever they damn well wanted to YouTube, who is only functioning right now the way it is because Google decided to let them run themselves under Google. Basically, YouTube is still owned by YouTube in actions, but Google pulls the strings if they need to. |
