We finally got a break from the heat and I was enjoying having the patio door open. Then the smoke came in and it really irritates my throat and stinks up the house. They come outside to smoke and sit right against the fence near my door. The trouble with summer is if it isn't barbecue smoke it's cigarette smoke. There's nothing I can do about it either since people are allowed to smoke outside. Winter is starting to look better all the time.

If they are smoking anywhere near the air intake for the air conditioner, the cigarette smoke will be drawn into that air intake and will pass through your residence. I went to the dollar store and purchased a cover to place over the vent in my office as that it where it is the worst. coming from my neighbor below. I also installed a ceiling fan with a light in my office and that has solved the problem nicely.

Your complex must have some form of bylaws and/or Rules/Regulations that cover things like pets, noise, smoke, parking, maintenance, etc. If not, then at the next annual general meeting, the subject can be brought up and put into the complex bylaws.

The Smoke-Free Ontario Act is designed to protect the health of all Ontarians by prohibiting smoking in all enclosed workplaces and enclosed public places in Ontario as of May 31, 2006.

The Smoke-Free Ontario Act:

•Bans smoking in enclosed public places and all enclosed workplaces as of May 31, 2006, including restaurants, bars, schools, private clubs, sports arenas, work vehicles, offices and entertainment venues, including casinos, bingo halls, bowling and billiard establishments
•Eliminate designated smoking rooms (DSRs) in restaurants and bars, permit residential care facilities to operate controlled smoking areas which are specially designed to ensure nobody outside the room is exposed to second-hand smoke. The law stipulates who may enter the area and under what conditions, as well as requirements for engineering design, function and maintenance of these areas
•Protect home health care workers from second-hand smoke when offering services in private residences
•Prohibit smoking on patios that have food and beverage service if they are either partially or completely covered by a roof
•Toughen the rules prohibiting tobacco sales to minors
•Prevent the promotion of tobacco products in entertainment venues
•Immediately restrict the retail promotion of tobacco products and impose a complete ban on the display of tobacco products by May 31, 2008

My province went one step further and added that smoking in condos & townhomes is not permitted. One can smoke inside their own unit but not on a deck or patio or within 20 ft. of a window or another patio. BBQ's [natural gas & electric only] are permitted as per our own bylaws but most owners opt to have decks/patios enclosed which is permitted in my complex. I know a lady with asthma and the tenants below smoked on their deck causing her to be ill. She asked the tenants below to refrain and why but they ignored her. She complained to me [I was a strata councilor at that time] and I went directly to the landlord. Issue is resolved and this woman can now sit and enjoy her deck. If the tenants wish to smoke, they can purchase air filters or whatever is needed to get rid of their ciggie smoke in their unit.

So sorry to see that some of you are struggling to stay smoke free in your own home.

I am fortunate in having perimeter walls as well as fencework AND bushes, and importantly - space/distance, and 'level' difference. I can still 'chat over the garden fence' if I want to, but I don't get any personal smoking drift that I notice. Actually my present neighbours don't seem to be smokers. I do get an occasional smell of BBQ smoke from 4 houses away, but it is quite diluted. Fortunate indeed by the looks of it, especially as I have heart and breathing issues myself - never been a smoker.

I once had the manager at an apartment I was considering, tell me "it would be no use having "no smoking" rules; how would you police it?" Needless to say, I looked elsewhere. I think he was just a lazy sod, and could not be bothered. The manager of the place where i did rent had no trouble at all enforcing a smoking ban. But she was a bit of a dragon. Plan to move into a condo when my house sells; not sure how that will go.
